Terms of Service

These Terms of Service (the “Terms”) govern your use of the website at claritus.one (the “Site”), operated by Catalyze Labs LLC (“Catalyze Labs”, “we”, “us”). By using the Site you agree to these Terms. If you are using the Site on behalf of an organization, you agree to them on its behalf. If you do not agree, please do not use the Site.

The Site provides general information about Claritus.One. Product screens, metrics, organizations, people, briefs and scenarios shown on the Site are illustrative demonstration data for fictional organizations. They are not customer results and are not a promise of any particular outcome.

Descriptions of features, capabilities, integrations and roadmap are provided for information and may change. Nothing on the Site is an offer to sell, a binding description of the product, or a commitment to deliver any functionality.

Access to the Claritus.One platform is provided only under a separate written agreement between Catalyze Labs and the customer organization. These Terms do not grant any right to use the platform, and if those agreements conflict with these Terms, the written agreement controls.

You agree not to:

• use the Site in violation of any law or regulation;
• submit protected health information, or any information you do not have the right to share, through the Site’s forms;
• interfere with or disrupt the Site, probe or test its vulnerability without our written permission, or attempt to gain unauthorized access to any system;
• send automated or bulk submissions, or scrape the Site in a way that places an unreasonable load on it;
• copy, frame or redistribute the Site’s content, design or demonstration materials for commercial purposes without permission;
• misrepresent your identity or your affiliation with any organization.

The Site and its content — including text, graphics, interface designs, demonstrations, code, and the Claritus.One name and mark — are owned by Catalyze Labs or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for your own informational purposes. All other rights are reserved.

Third-party names, products and trademarks referenced on the Site belong to their respective owners.

Information you submit through the Site is handled as described in our Privacy Policy. If you send us ideas, suggestions or other feedback about Claritus.One, you agree that we may use it without restriction or obligation to you.

The Site may link to websites or services we do not control. We are not responsible for their content, policies or practices, and a link is not an endorsement.

Content on the Site is general information about healthcare operations software. It is not medical, clinical, legal, financial or compliance advice, and should not be relied on for any clinical decision or patient care.

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ITS CONTENT IS ACCURATE OR COMPLETE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CATALYZE LABS AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

You agree to indemnify and hold Catalyze Labs harmless from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Site.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

We may update these Terms from time to time by posting a new version with a new effective date; your continued use of the Site means you accept the updated Terms. We may suspend or restrict access to the Site at any time. If any provision of these Terms is found unenforceable, the rest remain in effect.
